DMCA Policy for Train.Coach

Train.Coach ("Train", "we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding claims of copyright infringement.
1. DMCA Takedown Notification
If you believe that material hosted on Train.Coach infringes your copyright, you may submit a takedown notice to our designated agent. To be effective under the DMCA, your notification must include the following information:
- Your full name, mailing address, telephone number, and email address.
- A description of the copyrighted work you claim has been infringed.
- A description of the allegedly infringing material, including its specific location (URL) on our platform.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by thecopyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
- Your electronic or physical signature.
Why we require your address: Under U.S. copyright law, a physical address is required to process a valid DMCA claim. Your address will only be used as required by law—for example, to notify the alleged infringer—and will be stored securely and solely for the purpose of processing the DMCA request.
2. DMCA Counter-Notification
If you believe that your material was removed (or access to it was disabled) in error or misidentification, you may file a counter-notification. Your counter-notice must include:
- Your full name, physical mailing address, telephone number, and email address.
- Identification of the material that has been removed or to which access has been disabled, and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, to the jurisdiction of the U.S. District Court for the District of New Mexico, and that you will accept service of process from the person who provided the original DMCA notice.
- Your electronic or physical signature.
Why we require your address: The law requires it in case the original copyright holder decides to file legal action. Your address will only be disclosed to the other party in accordance with the DMCA and stored securely for the purpose of handling the claim.

4. Repeat Infringer Policy
Train.Coach maintains a policy of terminating, in appropriate circumstances, users who are determined to be repeat infringers. We also reserve the right to disable or remove access to content or accounts at our sole discretion.
5. Misrepresentations
Please note that under 17 U.S.C. §512(f), any person who knowingly makes false claims regarding copyright infringement or a counter-notification may be subject to liability.
6. Policy Updates
We may update or modify this DMCA Policy at any time without prior notice. Updates become effective immediately upon being posted to this page. We encourage users to check back regularly for any changes.
